These are the terms and conditions for use of the 'Instructor bookings' system developed by Darren Berrecloth t.a. Melgab.
1. Who is this contract between?
The contract is between us (Melgab) and you, not any other person or organisation you book facilities for.
2. Licence
You may use this system for as long as your payments are up to date. You can transfer your login to another user should you wish to but any sales are to be conducted completely separately from Melgab.
3. Using the system
This system has been built with flexibility in mind and can be used on most computers and web enabled mobile devices. It relies on up to date, standards compliant browsers being used such as Google Chrome, Safari or Firefox. We cannot guarantee all facilities will display or work correctly if you use a non-complient browser such as Internet Explorer and recommend that you download an alternative.
Pupils can register with you but should you have an occasion to block a registered pupil, you can do so in the pupil editing section of the panel. This will stop them being able to use any of the systems facilities until you allow access again.
4. Payments due
You can pay for the system monthly, quarterly, half yearly or annually depending on what suits you best at the time. Last payments will result in suspension of all automated services including reminder mails and texts. Renewals more than 14 days overdue can result in all data being removed from the system. We advise you to contact us immediately should there be a problem with making payments.
Pupils will still be able to register and make bookings for a short time after your renewal has become overdue.
5. Making payments
You can make payments using a credit or debit card. Card payments are processed by PayPal but this does not require you to have a PayPal account. Sorry but cheques are not accepted. Standing order payments can be accepted by arrangement.
No payment details, such as card information, is kept by us.
6. Data privacy
Your details, and those of your pupils will be used solely for the purposes of this system and will not be shared with any third parties.
7. Pupils testimonials
Your registered pupils have the facility to add comments to the system. We accept no responsibility for any abuse of this facility by pupils or anyone else using it.
8. Downloadable content
You can load Word or PDF documents to system for your pupils to download. What you upload is entirely up to you but any copyright infringements are solely your responsibility. Should we be advised of an infringement, documents will be removed until it has been confirmed that they are ok to use. Any abusive or inappropriate documents will be removed without notice and the facility could be removed.
We reserve the right to cancel your login immediately, without refund, if inappropriate (abusive, adult, racist etc.) documents are loaded.
9. Use of generic terms and conditions page
We supply a standard terms and conditions page which is displayed in the pupil panel. Please note that these have not be written by a legal expert and we recommend that you change these to suit your needs as soon as possible after registering. We accept no responsibility for any issues arising from the use of the statement.
10. Data
Although all efforts are made to ensure data integrity, no claim for compensation will be accepted for any loss, or incorrect input, of data by the system. The system can be used to retrieve data in various ways for use and display within the facility. Under no circumstances will data be exported and supplied in alternative formats eg. sql, csv etc
11. Cancellations
There is no contract and no minimum term that you have to use the system for. Should you not want to continue using the system, you just don't renew. Refunds will not be issued under any circumstances.
